Fish & Bear Pictures Terms of Use

Agreement Between User and Fish and Bear Pictures. The Virtual Gallery of Secret Art is a part of the Hidden Letters film website (www.hiddenlettersfilm.com). By submitting your art, you agree to be bound by all the terms, conditions and notices contained herein (the “Terms”). Please read the following terms carefully, prior to any use of this site, and keep a copy of them for your reference. If you do not agree to these terms, you should not submit any art to the Virtual Gallery of Secret Art. Fish and Bear Pictures reserves the right, at any time and in its sole discretion, to change the Terms. The most current version of the Terms will supersede all previous versions.

SALES

Fish and Bear Pictures does not engage directly in selling the artwork featured in any of its online exhibitions on the Hidden Letters Film website. Fish and Bear Pictures does not represent artists in the online exhibitions on its website. All inquiries from potential buyers who see your artwork on the Hidden Letters Film website will be directed to your or your designee for negotiation.

EMAIL SUBSCRIPTION

By submitting artwork to Fish and Bear Pictures, you understand and agree that they are “opting in” and will be placed on our email list and will receive future email announcements and email notices from us. If you want to be removed from this email list, please click the unsubscribe link at the bottom of any email and we will remove you immediately from all future emails.

POLICIES

Artists who submit an entry and images to Fish and Bear Pictures must agree to the terms and conditions of this prospectus. In addition to the criteria mentioned in the previous sections, the following policies apply:

Submissions received after the posted deadline (March 15, 2023) will not be considered.
You will notify us by email should you wish to substitute images.
All work must remain in the online exhibition for the entire duration of the exhibition.
Fish and Bear Pictures reserves the right to cancel an exhibition, extend deadlines, or change exhibition dates.
By submitting work to be considered for the exhibition, you grant Fish and Bear Pictures a non-exclusive perpetual license to reproduce the images of your artwork on our website, in the marketing of the Virtual Gallery of Secret Art including, but not limited to, the gallery’s social media network outlets, and promotion.
You agree that Fish and Bear Pictures can maintain an archive of your chosen artwork for posterity as part of a historical site record of past exhibitions.
These rules may be updated from time to time so please be sure to read them before you agree to them.

ELECTRONIC COMMUNICATIONS

Visiting hiddenlettersfilm.com or sending emails to Fish and Bear Pictures constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Fish and Bear Pictures does not knowingly collect, either online or offline, personal information from persons under the age of thirteen except with permission of a parent or guardian.

Fish and Bear Pictures reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Fish and Bear Pictures reserves the right to terminate your access to any or all the Communication Services at any time without notice for any reason whatsoever.

NO UNLAWFUL OR PROHIBITED USE/INTELLECTUAL PROPERTY

No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).

All artwork appearing on the Virtual Gallery of Secret Art remains your intellectual property of the original artist.

COPYRIGHTS & COPYRIGHT AGENTS

You expressly agree that your use of the service is at your sole risk. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information: (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (b) a description of the copyrighted work that you claim has been infringed; (c) a description of where the material that you claim is infringing is located on the Site; (d) your address, telephone number, and e-mail address; (e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (f) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Fish and Bear Pictures, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the site, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Fish and Bear Pictures reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Fish and Bear Pictures in asserting any available defenses.

PRIVACY

Fish and Bear Pictures reserves the right, and you authorize us by using our Site, to use and assign all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. Our Privacy Policy, as it may change from time to time, is a part of the Terms of Service and Use. You further agree that by supplying public information including but not limited to text and images, you are giving Fish and Bear Pictures the rights to display this public information on the site due to you participating in any of art competitions, art exhibitions, posts, pages, special sections and in all the Site’s marketing efforts. The artist retains all rights to their supplied text and images, but Fish and Bear Pictures reserves the right to edit or remove offensive or otherwise illegal images or text from its site.

CHANGES TO TERMS

Fish and Bear Pictures reserves the right, in its sole discretion, to change these Terms. The most current version of the Terms will supersede all previous versions. Fish and Bear Pictures encourages you to periodically review the Terms to stay informed of our updates.
